Terms of Service

Agreement

These terms are an agreement between you and BetaTCG, Inc., a Delaware corporation doing business as Setavaria ("we", "us"), for using the Setavaria website and the Setavaria apps for iPhone and Android (the "service"). By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

Who can use Setavaria

Setavaria is offered to people in the United States. You must be 18 or older to create an account. You are responsible for your account and for keeping your sign-in details secure. Tell us at support@setavaria.com if you think someone else has used your account. One person per account; do not share or sell accounts.

New accounts may need our approval before they can be used, and parts of the service may be offered only to invited or approved users, for example during a beta.

What Setavaria does

Setavaria helps you record and track a trading card collection: cards and copies, graded slabs, binders, pack openings, purchases and sales you enter, and estimated values. Card scanning suggests matches that you confirm.

Prices, values and gains are estimates based on market data and your own entries. They can be incomplete, delayed or wrong, and they are not an appraisal or financial advice. Check before you buy, sell or insure anything. Setavaria does not buy, sell or hold cards for you, and does not process the sales you record.

We keep improving the service, so features can change, be added or be removed. Beta and preview features may not work as expected and may change or end.

Plans and subscriptions

Setavaria has a free plan and paid monthly plans (Plus and Pro). What each plan includes is shown on the Plans page. Paid plans are subscriptions that renew automatically each month at the price shown when you subscribe until you cancel.

• Where you buy: in the iPhone app through the App Store, in the Android app through Google Play, or on the website through our payment processor, Stripe, where web subscriptions are offered. A subscription belongs to your Setavaria account, not to a device. Have one subscription at a time: while you have one in one place, we do not offer another elsewhere.
• App Store and Google Play: Apple or Google charges you, and you manage, cancel and request refunds under their terms and policies. For App Store purchases, Apple's standard license terms also apply.
• Web subscriptions: Stripe charges the card you give it; we never see your full card number. You normally manage your card, invoices, plan changes and cancellation through Manage subscription on the Plans page; if a change or cancellation is not available there, email billing@setavaria.com and we will make it.
• Upgrades (Plus to Pro) on the website take effect once paid; you are charged the prorated difference for the rest of the current period. Downgrades take effect at your next renewal.
• Cancelling: you can cancel at any time. You keep your plan until the end of the period you paid for; after that it does not renew. We do not give prorated refunds for unused time, except where the law or the store's policy requires.
• Failed payments: if a renewal payment fails, the store or Stripe retries it for a limited time, and your plan can continue while it does. If payment does not succeed, your paid plan ends.
• Price changes: we will tell you before a new price applies to your subscription, and you can cancel before it does.

If a paid feature is switched on when you subscribe, you can turn it off in Settings. Your records stay in your account if a paid plan ends, but paid features and higher limits stop.

Your content

The collection records, notes, images and other content you add stay yours. You give us permission to store, process and display your content to run the service for you, and to use your scans and their corrections to test and improve card recognition, as described in the Privacy Policy. Only add content you have the right to use.

Acceptable use

Do not misuse the service. For example, do not:

• break the law or others' rights, or upload content that is illegal, harmful or not yours to share;
• access accounts or data that are not yours, probe or bypass security or limits, or disrupt the service;
• scrape, copy, resell or redistribute the service, its catalog or its price data, use them to build or train a competing service, dataset or model, or use automated means to access it, except as we allow in writing;
• reverse engineer the apps, except where the law allows it.

Our service

Setavaria, its apps, design and software belong to BetaTCG, Inc. and its licensors. So do Setavaria's prices, values, price history and estimates, the card catalog and set lists as we compile and organize them, and the proprietary market price algorithms and methods behind them. Card names, images and text themselves belong to their publishers, as described in the Trademark and Copyright Notice below.

Trademark and Copyright Notice

Setavaria shows card names, images, text, symbols and other game information so you can identify and track the cards you own. That material belongs to the companies that publish the games and to the artists who created it. We do not claim ownership of it, and showing it does not mean any publisher endorses Setavaria. Card information (set lists, card pages and search) is free on every plan. Paid plans pay for Setavaria's own features, such as purchase and value tracking, binders, rips, trades and sales, not for access to card information.

Magic: The Gathering. Portions of Setavaria are unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Not approved/endorsed by Wizards. Portions of the materials used are property of Wizards of the Coast. ©Wizards of the Coast LLC. The literal and graphical information about Magic: The Gathering, including card images and mana symbols, is copyright Wizards of the Coast, LLC.

Pokémon. The literal and graphical information about the Pokémon Trading Card Game, including card images and text, is copyright The Pokémon Company, Nintendo, Game Freak and/or Creatures. Setavaria is not produced by, endorsed by, supported by or affiliated with The Pokémon Company, Nintendo, Game Freak or Creatures.

Disney Lorcana. Disney Lorcana TCG card names, images and text are trademarks and/or copyrights of Disney and Ravensburger. Setavaria is not published, endorsed or specifically approved by Disney or Ravensburger.

Riftbound. Setavaria was created under Riot Games' "Legal Jibber Jabber" policy using assets owned by Riot Games. Riot Games does not endorse or sponsor this project.

Palworld. Palworld and the Palworld Trading Card Game, including card names, images and text, are trademarks and/or copyrights of Pocketpair, Inc. and Bushiroad. Setavaria is not produced by, endorsed by or affiliated with Pocketpair or Bushiroad.

Logos. Game names, game logos and set symbols shown in Setavaria are trademarks of their respective companies and are used only to identify their games and sets.

Artists. Card art belongs to its artists and publishers. We show cards with their artist credit and copyright line intact and do not add our own marks to card images.

Prices. Prices and values in Setavaria are estimates produced by Setavaria's proprietary market price algorithms. They are for information only, are not an offer to buy or sell, and may be wrong or out of date. Setavaria is not affiliated with any marketplace.

Copyright concerns. If you own rights in something shown on Setavaria and want it changed or removed, see our Copyright Policy, which names our designated agent and explains what a notice must include.

Other services

The service relies on others, such as Apple, Google, Stripe and our hosting and sign-in providers. Their own terms and policies apply to what they do. We are not responsible for services we do not control.

Suspension and ending your account

You can delete your account at any time from the Account page, as described in the Privacy Policy. If you have a web subscription, we cancel it when the 7-day window to keep your account closes, without a refund for the rest of the period; a renewal that falls inside those 7 days can still be charged, so cancel first (or email billing@setavaria.com) to stop billing sooner. Deleting your account does not cancel an App Store or Google Play subscription; cancel it in that store.

We may suspend or close an account that breaks these terms, puts others or the service at risk, or when the law requires. Where reasonable, we will tell you why and give you a chance to fix it.

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or accurate, including prices, values and scan matches, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Keep your own records of anything important to you.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the service. Our total liability for any claim about the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim, or US$50. Some places do not allow these limits, so they may not apply to you.

Changes to these terms

We may update these terms. We will post the new version here with a new effective date and, for important changes, tell you in advance by email or in the service. If you keep using the service after changes take effect, you accept them; if you do not agree, stop using the service and cancel any subscription.

Governing law

These terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
